Terms and Conditions for 3ash

1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you ("you") and Amr Nader and the 3ash team ("we," "us," or "our"), concerning your access to and use of the 3ash mobile application. By accessing the app, you agree that you have read, understood, and agreed to be bound by all of these terms. If you do not agree, you must discontinue use immediately.

2. Account Security

You are entirely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Nature of the Platform & Medical Disclaimer

Technology Platform, Not a Healthcare Provider: 3ash provides a digital marketplace and platform that connects clients with independent fitness and nutrition professionals (collectively referred to as "Providers"). We do not provide medical, fitness, or nutritional advice directly. The Providers on the platform are independent professionals and are not employees, agents, or representatives of 3ash.

Assumption of Risk: Any advice, workout plans, or dietary information provided by a Provider on this app is solely their responsibility. We do not endorse, guarantee, or assume liability for the accuracy, safety, or effectiveness of any advice given. You voluntarily assume all known and unknown risks associated with these physical activities. You should consult a physician before beginning any new fitness or nutrition program.

4. User-Generated Content (UGC) & Conduct

The 3ash platform allows independent Providers and users to post content (such as text, images, and updates). By using the app, you agree to the following strictly enforced rules:

Zero Tolerance: We strictly prohibit hate speech, harassment, explicit/sexual content, violence, self-harm promotion, and illegal activities.
Reporting and Blocking: You have the ability to flag inappropriate content via the "Report" button on any post, and you may block abusive users directly from their profiles. We act on these reports within 24 hours.

5. Right to Monitor, Review, and Terminate

Amr Nader and the 3ash team reserve the absolute and unconditional right to monitor, review, retain, and disclose any User-Generated Content, communications, or activity on the platform. Furthermore, we reserve the right, at our sole discretion, to suspend or terminate your account, block your access to the app, or remove any content at any time, for any reason, without prior notice, explanation, or liability.

6. Payments, Subscriptions, and Withholding

To access premium features and connect with Providers, you must subscribe to our services. Because 3ash utilizes independent billing, the following rules apply:

Manual Verification: Payments are processed via manual bank transfer. You must upload a clear, unaltered receipt of the transfer. Verification may take between 24 and 48 business hours.
Fraudulent Receipts: Submitting forged, edited, or false payment receipts is a severe violation and will result in an immediate, permanent ban without refund.
Provider Payouts and Withholding: If you are a Provider receiving funds through the 3ash platform, we reserve the right to delay, suspend, or completely withhold any pending payouts if we suspect, receive reports of, or are actively investigating any violation of these Terms, fraudulent activity, or other wrongdoing. Funds may be held indefinitely during an investigation and may be permanently forfeited to cover user refunds or damages if wrongdoing is confirmed.

7. Intellectual Property

All platform infrastructure, features, and functionality of the app are the exclusive property of Amr Nader and the 3ash team and are protected by international copyright laws. This does not include the independent User-Generated Content owned by individual Providers.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Amr Nader, the 3ash team, or our affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for physical injury, loss of profits, goodwill, or data arising out of or relating to the use of the platform or reliance on an independent Provider.

9. Privacy Policy

Your use of the platform is also governed by our Privacy Policy. By agreeing to these Terms, you acknowledge and agree to the data practices described in our Privacy Policy.

10. Modifications to Terms

We reserve the right to update or modify these Terms at any time. We will notify users of significant changes, but continued use of the app after any changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of competent jurisdiction.
